AlphaGenome API Additional Terms of Service

Use of the AlphaGenome API is subject to the Google APIs Terms of Service and AlphaGenome API Additional Terms of Service.

Key things to know

  1. The AlphaGenome API is only available for non-commercial use by individuals and non-commercial organizations (universities, non-profit organizations and research institutes, educational and government bodies), or for journalism.
  2. You must not use AlphaGenome API or outputs:
    1. in connection with any commercial activities, including research on behalf of commercial organizations; or
    2. to train machine learning models or related technology for predicting the effects of genetic variants similar to AlphaGenome.
    3. for clinical purposes or rely on them for medical or other professional advice.
  3. Your individual AlphaGenome API developer credentials are personal and must not be published or shared, even within your organization.
  4. You can publish, share and adapt output in accordance with the Terms, including the requirement to provide clear notice that ongoing use is subject to AlphaGenome Output Terms of Use and of any modifications you make.

Besides our terms, we also publish a Privacy Policy. Although it's not part of our terms, we encourage you to read it to better understand how you can update, manage, export, and delete your information. Notwithstanding the "Exporting & deleting your information" section of our Privacy Policy, if you would like to update, manage, export or delete your information related to AlphaGenome API, please contact alphagenome@google.com.

By using Google's AlphaGenome API, or the other Google APIs that reference these terms (collectively, "AlphaGenome API"), you agree to be bound by these AlphaGenome additional terms of service ("Additional Terms") in addition to the Google APIs Terms of Service (the "API Terms") (together, the "Terms"), in each case (a) as modified from time to time in accordance with the Terms, and (b) between you and (i) if you are from a country in the European Economic Area or Switzerland, Google Ireland Limited, or (ii) otherwise, Google LLC.

Terms that are not defined in these Additional Terms have the meanings given in the API Terms. Any system or application through which you use or into which you embed the AlphaGenome API is an "API Client" under the API Terms. When we say "you", we mean the individual or organization using the AlphaGenome API and all related information, including (a) any model output and related information provided by AlphaGenome ("Output"), and (b) any visual representations, computational predictions, descriptions, modifications, copies, or adaptations that are substantially derived from Output ("Derivatives") (together, the "AlphaGenome Assets"). When we say "we", "us" or "Google", we mean the entities that belong to the Google group of companies, which means Google LLC and its affiliates.

In addition to Section 1 "Account and Registration" of the API Terms, you may only access and use the AlphaGenome API for individual use, journalism, or use for, or on behalf of, a non-commercial organization (i.e., a university, non-profit organization or research institute, or educational or government body). The AlphaGenome API isn't available for any commercial entity, even if conducting non-commercial work. In using AlphaGenome API on behalf of an organization, you confirm you are authorized either explicitly or implicitly to enter, and are entering, into the Terms as an employee on behalf of, or otherwise on behalf of, your organization.

Subject to your compliance with the Terms, you may access, use and modify the AlphaGenome Assets and distribute Output and Derivatives. We grant you a non-exclusive, royalty-free, revocable, non-transferable and non-sublicensable (except as expressly permitted in these Terms) license to any intellectual property rights we have in the AlphaGenome Assets to the extent necessary for these purposes. In order to verify your access and use of the AlphaGenome Assets, we may from time-to-time ask for additional information from you, including verification of your name, organization, and other identifying information. You will respond promptly, accurately and comprehensively to such requests.

In addition to Section 4 "API Prohibitions" of the API Terms and any requirements identified in the AlphaGenome API or related documentation made available to you by Google, you must comply with the use restrictions set out below.

You must not use nor allow others to use the AlphaGenome API Assets:

  1. On behalf of a commercial organization or in connection with any commercial activities, including research on behalf of commercial organizations. The only exception is journalism.
    1. This means that only individuals and non-commercial organizations (universities, non-profit organizations and research institutes, educational and government bodies) may use the AlphaGenome Assets and only for non-commercial purposes. The only exception is journalism which is permitted. The AlphaGenome Assets aren't available for any other types of organization, even if conducting non-commercial work.
    2. You must not share Output or Derivatives with any commercial organization or use the AlphaGenome API in a manner that will grant a commercial organization any rights in Output or Derivatives, in each case aside from indirectly via a scientific publication, open source release or to support journalism.
  2. To reverse engineer, disassemble, republish, copy, modify, distribute, transfer, sell, or otherwise grant or permit access to AlphaGenome API, including the underlying data or models (e.g., parameter weights), except to the extent such reverse engineering is allowed by applicable law. This doesn't stop you from using and sharing Output or Derivatives in accordance with the Terms.
  3. To train machine learning models or related technology for predicting the effects of genetic variants similar to AlphaGenome.
  4. Without providing conspicuous notice that any Output or Derivatives you publish or distribute are provided under and subject to AlphaGenome Output Terms of Use and of any modifications you make to Output.
    1. By way of example, you can do this by sharing a copy of the AlphaGenome Output Terms of Use and a "Legally Binding Terms of Use" text file that contains the following notice: "By using this information, you agree to AlphaGenome Output Terms of Use found at https://deepmind.google.com/science/alphagenome/output-terms".
    2. If you provide additional or different terms and conditions for use, reproduction or distribution of Output or Derivatives, you must include the "Use Restrictions" section of these Terms as an enforceable provision and provide clear notice to subsequent users that Output or Derivatives are subject to such use restrictions.
  5. To misinform, misrepresent or mislead, including:
    1. using AlphaGenome API on behalf of an organization without telling us when you sign-up or by updating us via your profile page;
    2. misrepresenting your relationship with us;
    3. misrepresenting the origin of Output or Derivatives;
    4. distributing misleading claims of expertise or capability made particularly in sensitive areas (e.g., health); or
    5. making decisions in domains that affect material or individual rights or well-being (e.g., healthcare).
  6. To perform or facilitate dangerous, illegal or malicious activities, including:
    1. publishing or sharing your individual AlphaGenome API developer credentials, even within an organization, as these are personal;
    2. promoting or facilitating the sale of, or providing instructions for synthesizing or accessing, illegal substances, goods or services; or
    3. attempting to override or circumvent safety filters or intentionally drive the model to act in a manner that contravenes our Terms.

In addition to Section 5 "Content" of the API Terms, AlphaGenome may allow you to generate original content. Although you must comply with these Terms when using the AlphaGenome Assets, Google won't claim ownership over that content. However, you acknowledge that we may generate the same or similar content for others, including Google, and that we reserve all rights to do so.

In addition to Section 8.b "Your Obligations Post-Terimination" of the API Terms, if Google terminates your right to access or use the AlphaGenome API due to: (a) your failure to fully comply with the Terms, (b) our compliance with a legal requirement or court order, or (c) our belief that your conduct causes harm or liability to a user, third party or Google, you must immediately stop using and delete all copies of the Output and Derivatives in your possession or control, require all third parties (except for scientific journals) that you have shared any Output or Derivatives with to stop using and delete such Output and Derivatives, and are prohibited from using the AlphaGenome Assets, including by submitting another application to use the AlphaGenome API.

In addition to Section 8.c "Surviving Provisions" of the API Terms, the following provisions of these Additional Terms will survive termination of the Terms: "Content", "Termination", "Liability for AlphaGenome API" and "General Legal Terms".

Google does not currently levy a charge for your access and use of the AlphaGenome API. However, without prejudice to our other rights, Google reserves the right to charge fees for access to the AlphaGenome API by providing you with at least one month’s prior written notice. Where Google introduces fees, your use of the AlphaGenome API will be subject to payment of the applicable fees and may be subject to additional terms and conditions. If you do not wish to pay the fees, you must stop using the AlphaGenome API immediately.

Nothing in these Terms restricts any rights that cannot be restricted under applicable law or limits Google's responsibilities except as allowed by applicable law. If you are legally exempt from certain responsibilities, including indemnification, then those responsibilities do not apply to you under the Terms.

The AlphaGenome API includes experimental technology and may sometimes provide inaccurate output. Output are predictions with varying levels of confidence and should be interpreted carefully. Use discretion before relying on, publishing, or otherwise using Output provided by the AlphaGenome API.

AlphaGenome Assets are for theoretical modelling only. They are not intended, validated, or approved for clinical use. You should not use AlphaGenome Assets for clinical purposes or rely on them for medical or other professional advice. Any content regarding those topics is provided for informational purposes only and is not a substitute for advice from a qualified professional.

Notwithstanding Section 9.b "Limitation of Liability" of the API Terms, where the AlphaGenome API has been provided to you for free, to the extent permitted by law, Google's total aggregate liability for all claims arising out of or in connection with the Terms or the AlphaGenome Assets, including for its own negligence, is limited to $500.

Given the nature of scientific research, it may take some time for any breach of these Terms to become apparent. To protect you, us, and the AlphaGenome API, to the extent allowed by applicable law:

  1. any legal claims relating to these Terms can be initiated until the later of:
    1. the cut-off date under applicable law for bringing the legal claim; or
    2. two years from the date you or Google (as applicable) became aware, or should reasonably have become aware, of the facts giving rise to that claim.
  2. you won't argue limitation, time bar, delay, or the like in an attempt to bar an action filed within that time period, and neither will we.

To the extent that applicable local law prevents certain disputes from being resolved in the courts specified in Section 10.c "General Legal Terms" of the API Terms, you and Google can file those disputes in your local courts. To the extent that applicable local law prevents your local courts from applying the governing law specified in Section 10.c "General Legal Terms" of the API Terms, these disputes will be governed by the applicable local laws of your country, state, or other place of residence.
